There is a n area in our yard where we would like to plant a tree but we know it will be near a water pipe are there any trees you could suggest that have roots that grow more straight down as opposed to ballooning out?

Unfortunately, even deep rooted trees will send out more horizontal anchoring roots in all directions, so it is still not a good idea to plant large trees near utilities such as water lines.
