Empress tree is not a good long term option for that spot. I suggest crape myrtles. The 'Natchez' variety is a great choice. It gets large, has white blooms and beautiful cinnamon bark.

Most any tree is a problem around a root system. So you basically need to choose a shade tree you like and it should be fine as long as the septic system is not right next to it and is properly constructed. Lacebark elm is a good choice for a shade tree but there are many other great options including Shumard oak and white oak.
