I am looking for a tree to plant that does not get larger than 45

There are not many trees that will remain that small but you might consider a dwarf apple or columnar apple (tall and narrow) or Thuja (tall and narrow but no flowers). Or, camellia trained into a single trunk makes a nice tree like specimen. Wish I had other suggestions!
