After mulching around my young oak I've noticed the top of the tree has died and the new growth is only on the lowest branches.

Mulching should not affect the top growth of a tree, unless the mulch is extremely thick and dumped in a pyramid shape over the roots and trunk of the tree. When the top dies down on a tree it usually indicates root stress. This can be caused by overly wet soils or droughty conditions. In general, your oak tree will need one deep soaking per week to maintain good health.
