i want a tree that is about 5ft. high, that i want to plant outside my fence, one that will be good for winter too, mainly low maintenance and will not damage my fence

Five feet isn't very tall for a tree! You might consider growing a dwarf apple tree or a dwarf conifer. Most will max out at 5'. An alternative would be to plant an evergreen such as a camellia and prune it into a tree shape. Good luck with your new tree!
