Like a plant in solanaceae family. I think i have seen this before. It have yellow fruit right ?

It also might have red berries - it looks like common nightshade to me. The berries are highly poisonous.

No berries have shown yet. Also no fruit. It grows in the shade of a magnolia tree and is only 4 foot tall.
