So, if a person did not know Peggy Higdon, Cancun Pink and Playful were the same, they could have three of the same plant with different names.

That is exactly right which is why it is such a bad idea to give existing plants new names.
But Gigi is right, if you have a seedling it will be a new variety and you can name it yourself.
