Ramifications of planting during winter

My landscape designer/project manager bought plants for my yard, but her installer has not been able to get to the job. The plants are sitting in pots in her yard, which has some protection from surrounding buildings, and she probably takes care of them. She said she would like to plant them as soon as possible, but this is now January. She has guaranteed the plants through the first growing season, with an exception for extreme weather. I am concerned about planting now. What would be the possible ramifications if I allow her to go ahead and plant now? I have offered to let her plant if she removes the extreme weather provision, but she has not been willing to do so.
