I bought a japanese maple ever red that has a branch with no leaves on it. Is this safe to take off? I have read you should wait till late fall. Also a few leaves are dying...is that normal and should i just take them off...at what point should i be concerned? Does this tree lose leaves in the winter as well?

If the branch in question is dead, there's no reason you cannot prune it off your maple. A few dying leaves should not cause alarm. The branch will probably send out new leaves to replace the lost ones. Maple trees are deciduous so they will drop their leaves in the late fall. Enjoy your new tree!
