Plant ID forum: Is this a holly?

My better half (Jon) stopped along the road to pick up this plant that he thinks must have fallen off of a landscape trailer or ?? He lovingly presented it to me when he got home. I hated to say that i think it has some kind of disease or fungus and I'm not even sure of what it is. Im thinking its a holly? It has some discoloration and some deformed leaves.....what might be causing this? I know Jon cant wait to see me install this in our yard, but before i do that i need a little more education! It does seem to have some sort of fungus. An expert will surly be along soon with more complete answers.
