Is it illegal to take an Ocotillo from the desert and planet?

Hi Davidy, Welcome!

I don't think it's legal to dig up/remove/take Ocotillo (Fouquieria splendens) or ANY plant without explicit permission from the property/land owner.

Depends on where you want to collect. Az. lists it as "salvage restricted" FOSP2, Most of the areas in Ca. that it grows are desert reserves, where it is against the law to collect anything. You can find them for sale on line, if not locally.

This is one of the reasons we ask where you are located; the answer will differ from one state to another but generall the Ocotillo is protected. If it is not your plant on your land, assume the answer is yes, it would be illegal. Better to buy from a reputable nursery and avoide prosecution. Rolling on the floor laughing Thumbs up Thumbs up
