My mimosa tree hasn't leafed out yet and I don't know what's wrong with it

If you scratch the bark and under it is still green, your tree is still alive. If the twigs are brittle and it is dry under the bark, the tree may have died.

The bark is green so I know it is still alive but about 3 in from the tips are dry and brittle

Good! I would go ahead and cut off the dead tips and just wait and see. I cannot imagine why it would be so late leafing out.
