Yes, it is a nightshade.

Looks like nightshade which yes, is very poisonous.

It is not deadly nightshade (Atropa belladonna) but something in Solanum genus. Not edible, but not "deadly."

Suggestions to compare to your plant:
Common Nightshade (Solanum americanum)
Black Nightshade (Solanum nigrum)
