I've got the same Tree Aloe (Hercules) in my yard for 3 years now. It has always struggled and it is not the dark green color when it came from the nursery. Nobody seems to know whether it has a too much or too little water. I believe that in the summer when hot it needs enough water to prevent damage. Our solid bedrock is clay and when planted on this slope, a large hole was dug in the hard clay solid with the bottom sloped down and open toward the drainage to prevent pooling. It is probably a good idea to mulch around the tree to keep the roots from getting too hot if in the direct sun for long hours. Or planting something like feather grass around the base to provide some shade.

Planting in a hole in the clay is almost exactly the worst possible situation I can think of for tree aloes. It would have been preferable to plant it in a raised bed. Maybe lifting it is an option.
They don't need shade. They do need water in some climates, and when in pots. Same goes for fertilizer in some soils, or in pots. In my nursery we fed all summer. You may need to lime the soil if your clay is acid.
