Tara, I finally went back and found the pictures of the one I had that was similar to yours. It was Beallara Tahoma Glacier, and both Jim and Ted had one the same. All ours weren't quite as brightly colored as yours, but certainly the same shape.
As far as the little black spots go, I'd keep an eye on them but don't worry unless they spread, or get a lot bigger. Looks like most of the leaves are nice and clean.
