I agree, a Holly of some type and although some have berries that are edible to birds I don't know of any that are edible to humans.

Dahoon Holly (Ilex cassine)
Dwarf Burford Holly (Ilex cornuta 'Burfordii Nana')
Chinese Holly (Ilex cornuta)
