I agree It is Podocarpus... Our neighbor has a line of them along the fence, and the Mockingbirds adore the berries! It also makes wonderful shelter for the birds, for/from the occasional visitor/predator that drops in!

edited to add...as you can see in this pic they can get very large, even becoming trees if not kept in check/pruned.
