Sandsock, out-of-patent roses are often freely available from a lot of vendors. That just means that anyone can propagate them without paying royalties to the original breeder. The patent lasts 20 years. What we mean by out-of-commerce roses is that they are almost impossible to find from any vendor. There is a wonderful site called HelpMeFind Roses that you can check the availability of any rose. Click the search function and enter the rose name. Click on the "buy from" tab. If the only vendors listed are outside of the US, or the vendor listed is archive only, it's a very hard-to-find rose. I'd highly recommend going to HelpMeFind... it's an amazing resource!
