I would like to hope there is a way to deal with the fox without killing it. Can you call local animal control? Perhaps they have the jurisdiction to trap them (even though it sounds like the general public can't). I know the fox is a PITA, but I don't think that gives the right to kill it. Not trying to stir the boat, but as an animal lover, I try to find a harmless way to deal with a "pest." Bugs on the other hand...
