There is a daylily nursery here in Ontario that is already named Floral And Hardy. www.floralandhardy.ca/cart.html
They have other plants as well but the majority are Daylilies.
I believe you can have the same garden name as someone else has, as long as its in a different state. Business laws vary from state to state.
Here in Michigan you only have to have a name that is already not being used in the particular county you live in.
