Most of the "landscaping" companies are "mow and go". They don't know individual plants and would cut down anything that appeared to be dead (though they're dormant) and the workers really can't be blamed since they do what they're told to do, nothing more. Those with tree peonies better mark them with flags as a signal to leave it alone.
