pardon me for ranting ---
I just don't understand why people
1) can't use their own photos taken in their own garden
2) use the hybridizers photo and give them credit for the photo
3) ask permission before taking a photo and using it to make money.

I don't mind if people copy photos for their own files. But when you use photos you did not take for profit - I don't like that.

I have yet to turn down someone using one of my photos if they just ask and then give me a credit line. I know I am not a "professional photographer" but .... still... This is why I won't put any daylily photos on the database without a watermark. I appreciate that Dave has these features.

I know people taking your photos does not bother a lot of people. I just don't think it is the right thing to do.

I don't care if a picture of mine is used without permission. If someone asks I always of course do give permission. But if they don't and just use it, well I just don't care. I post so many pictures and all over the place. Pictures to me are just for sharing my garden out on the net and all sorts of forums. I am not any professional photographer. But since it upsets you then I am sorry that it happened to you Juli.

I think part of my thinking on this may be because I went to an art college. Photos are considered the property of the photographer, just as a painting would be.

I know I am being a pain about this. I can't help that it bugs me.

Rita, it is great that you don't care if anyone uses your photos.

I know that my pictures are considered my property but just don't see any reason to care if someones uses any for whatever. I am just showing off my garden.

Nope, not a pain Juli, I agree with you 100%. I go after anyone taking my images, I have had admin go to bat for me on DG with a eBay seller as well as a rose database owner who went after another eBay seller. I often sell my images and just because they are posted somewhere on the net does not make them open for taking. There are copyright laws. I always give permission if asked and I only ask for credit, it's the ones that deliberately crop and cut out the copyright that get me up in arms.

I have never refused anyone who asked permission and gave me credit for the photo.

It is a touchy subject - I remember this subject coming up a few times on the robin and there was always a heated discussion.

Today it was so nice here that I looked around at foliage. I'm trying to determine if some of my seedlings are semi-evergreen. I am trying to track how they look in the spring and fall each year for several years. Half of my daylilies are completely gone dormant. Some still show some green, and then a few that are evergreen here still look green and foliage is still a foot tall - even though it was down to 14 a couple nights ago, and it has snowed lightly a few times. Such as Spacecoast Cotton Candy, Cherry Burst, Lake Country Sunshine. Spacecoast Cotton Candy and Lake Country Sunshine are registered semi-evergreen, but here they act just like evergreens. Zazu Pitts is registered dormant, but acts semi evergreen here. So who knows. Shrug! But I want to try to track my seedlings over a handful of years and then compare notes.

I never thought of tracking foliage for the Daylilies in the winter. Now I'm going to have to go out in the morning and check on mine. : )

Well, I don't think it should be a touchy subject. If its your picture and no permission was granted then you have every right to be upset and look upon it as theft. For my own pictures, I don't care and don't bother my head about it.

Lynn, in Curt Hanson's catalogs that I used to do, I always had to work in a special "notes" type box where he explained how he determines foliage type. Here is what I used to put in his catalogs.

Curt Hanson said:Here in my zone 5 garden, I will not list a cultivar as dormant unless it goes completely underground before winter sets in. Instead, I will list it as semi-evergreen.


I have always gone by what Curt says on this, but the last couple years I have been checking them in spring too.

I see that you must have edited your post Juli of the cultivar name and the offender. Obviously they must have taken it from Rice, he gave you credit on his site so it's doubtful he would have given permission, I think it's extremely cheeky of the seller to actually put their name on it though! Hope you contacted them and they fix that soon.

Yes, I did edit. I had second thoughts about calling them out by name on this forum. This is not the place for it. But, bringing it up here is good because someone might be out there, newbie, reading this, and they never thought anything wrong about lifting a photo.

I did contact them, but have not heard back.

I'm not a member Juli. I only have about 10 different daylilies and I love them dearly. But my main passion is with the sempervivum. I have 350 different cultivars and species.
I don't think I could take on another plant hobby at this time. : )

I sure enjoy your photos though, and I love learning new things.

I would certainly ask the person for permission before suing one, that is only right. I would be horrified to see one of mine used without asking me. I would gladly let them use on if they asked.

Don't see anything wrong with using someone else's photograph IF credit is given to the original photographer. Otherwise, displaying one that you did not take as one of your "own" is misrepresentation and, in my opinion, constitutes a form of fraud. Which also leads to doubt about the integrity of the plants that person is trying to sell, and so on. Bad for everyone. Hope you have good luck with the response from him/her, Juli.

About a year ago I had a lily auction customer buy a lot of seeds from me then turned around and sold them again using my photos. I don't care what they do with the seeds once they buy them but this person did not ask permission to use my photos. I did email the person and they did apologize and I told them next time to email me first and ask and I would gladly let them use my photos. I can understand you getting a bit angry over someone doing that to you Juli.
